Bereavement leave for a funeral
The issue of taking leave from work to attend a funeral can occasionally affect any employee. Therefore, it is beneficial to know what rights an employee has in such situations and the specific circumstances involved. From a legal perspective, the relationship between the employee and the deceased is crucial in determining any entitlement to leave from work. All these legal prerequisites are stipulated by Government Regulation No. 590/2006 Coll., which defines the scope and extent of other important personal obstacles in work.
In this context, if an employee's spouse, partner, or child passes away, the employee is entitled to two days of leave with pay from the employer. One of these two days is specifically for attending the funeral. The employer can later verify whether the leave was used for this purpose by requiring the employee to provide confirmation from the crematorium or cemetery of their attendance at the funeral.
Additionally, an employee is entitled to one day of paid leave to attend the funeral of a parent or sibling, even if the deceased was related to the employee's spouse. This also applies to the spouse of the employee's child or sibling. Furthermore, the employee may take an additional day of leave if they are responsible for arranging the funeral of such a person.
Lastly, the regulation grants employees leave in the necessary extent of up to one day to ensure their presence at the funeral of a grandparent or grandchild (or the spouse's) or another person who lived with the employee in the same household at the time of death. The employee must provide proof to the employer if required. Employees can be granted an additional day of leave if they are taking care of all necessary arrangements related to the funeral of the deceased.
